Terms of Service - Obedio Mobile

1. Acceptance of Terms

By downloading, installing, or using the Obedio mobile application for iOS or Android (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms apply to all users, including crew members, yacht management, and administrators (collectively, "User(s)" or "you"). Your continued use of the App constitutes acceptance of these Terms.

2. License Grant

Branko Blagojević PR (trading as "Obedio") grants you a limited, non-exclusive, revocable, non-transferable license to use the App for its intended purpose: professional yacht-crew communication, service request management, and crew coordination.

Restrictions on use:

You may not copy, modify, adapt, reverse-engineer, decompile, or create derivative works of the App
You may not use the App for unauthorized commercial purposes
You may not remove copyright, trademark, or other proprietary notices
You may not use the App to interfere with, disrupt, or harm the security of the Obedio service or other users' devices

3. Acceptable Use

3.1 Permitted Uses

The App is provided for professional yacht operations. Permitted uses include:

Receiving and responding to guest service requests (voice + text)
Making crew-to-crew voice calls
Toggling on-duty/off-duty status
Viewing guest information and service context
Provisioning smart buttons over Bluetooth

3.2 Prohibited Uses

You agree NOT to:

Use the App for any illegal, unauthorized, or harmful purpose
Transmit malware, viruses, or code intended to harm the app or backend
Harass, threaten, defame, or impersonate other crew members or guests
Access or modify another user's account without authorization
Collect personal data from the app or other users without consent
Use the App in a manner that interferes with its operation or other users' access
Share your login credentials with unauthorized persons

4. Intellectual Property

All content, features, functionality, and materials in the App (including design, text, graphics, software, and source code) are owned by Obedio or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create (e.g., guest preferences, crew notes) subject to our right to store, process, and display such content within the App for operational purposes.

5. NOT a Life-Safety or Emergency System

Critical Disclaimer

The Obedio App is NOT a life-safety system, emergency communication platform, or substitute for official maritime safety protocols.

Critical communications (medical emergencies, security incidents, abandonment scenarios) are NOT guaranteed to be delivered reliably via Obedio
Network failures, connectivity loss, backend unavailability, or other factors may prevent message delivery or voice calls
You must not rely on Obedio for emergency or life-critical communications
All vessels must maintain independent, certified emergency communication systems per international maritime regulations (e.g., GMDSS, Inmarsat)
For emergencies, use dedicated maritime safety radio, satellite emergency systems, or direct distress channels

Obedio is intended for routine crew coordination and guest service - not emergency response.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

OBEDIO IS PROVIDED "AS IS" AND "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
IN NO EVENT shall Obedio be liable for:
- Loss of data, income, profits, or business opportunity
- Indirect, incidental, special, consequential, or punitive damages
- Damages arising from unauthorized access, data breaches, or misuse of credentials
- Service interruptions, downtime, or loss of functionality
- Third-party service failures (Open-Meteo, LiveKit, Google Firebase, Apple Push Notification service)
TOTAL LIABILITY: If any court finds Obedio liable, recovery is limited to the fees you paid for the App in the 12 months preceding the claim (or $0 if the App is free)
ESSENTIAL TERMS: These limitations apply even if Obedio has been notified of the possibility of such damages

7. User Data & Account Security

7.1 Your Responsibility

You are responsible for:

Maintaining confidentiality of your login credentials
All activity that occurs under your account
Notifying us immediately of unauthorized access (contact support@obedio.de)

7.2 Data Deletion

To remove your account and associated data:

Sign out of the app (clears local credentials)
Request account deletion from your yacht operator or Obedio administrator
Contact support@obedio.de if you need assistance

Your yacht operator may retain data as required by maritime regulations or internal governance policies.

8. Third-Party Services

The App integrates with third-party providers:

Service	Usage
Open-Meteo	Weather data (Android only)
LiveKit	Voice call routing
Google Firebase Cloud Messaging	Push notifications (Android)
Apple Push Notification Service	Push notifications (iOS)

We are not responsible for third-party service outages, security breaches, or data practices
Review the respective privacy policies of these services
Failure of any third-party service may impact App functionality

For App Store purchases on iOS, Apple's Standard License Agreement applies unless superseded by these Terms.

9. Termination

Obedio may suspend or terminate your access to the App if you:

Violate these Terms or applicable law
Engage in harassment, threats, or abuse
Attempt to damage or disrupt the service
Use the App for unauthorized purposes

Upon termination:

Your license to use the App is revoked
You must stop using the App immediately
Your account data will be retained or deleted per our Privacy Policy and yacht operator policy

You may terminate your account at any time by contacting support@obedio.de.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Serbia, without regard to conflict-of-law principles.

You agree to submit to the exclusive jurisdiction of the competent courts of the Republic of Serbia (Bela Crkva), and any legal action or proceeding shall be brought exclusively in those courts.

11. Dispute Resolution

Before pursuing litigation, you agree to first attempt to resolve any dispute informally by contacting us at support@obedio.de with details of the issue.

If informal resolution fails, the parties may agree to binding arbitration or mediation in accordance with applicable maritime law / jurisdiction standards.

12. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, or if that is not possible, severed. The remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Obedio regarding the App and supersede all prior agreements or understandings.
